TTT+Partners successfully represented Thaicom PCL and Gulf Development PCL (formerly Intouch Holdings PCL) in a significant dispute in which the Ministry of Digital Economy and Society (MDES) sought the revocation of an arbitral award issued in favour of Thaicom and Gulf Development concerning satellite concession obligations.
The arbitral tribunal had previously determined that the Thaicom 7 and Thaicom 8 satellites are not subject, nor related to the concession agreement between the companies and MDES.
MDES contended that the arbitral award contravened public policy or good morals on the grounds that the arbitral tribunal lacked the authority to consider the dispute.
The Central Administrative Court ruled in favour of Thaicom and Gulf Development, dismissing MDES’s petition to revoke the arbitral award. In its decision, the Court held that the arbitral tribunal had the authority to issue the arbitral award and that recognition and enforcement of the award do not contravene public order or good morals.
